Lasting Powers of Attorney

Lasting Powers of Attorney can be made by any person who wishes to authorise someone else to act for them if they become incapable of looking after their own affairs.

There are two types of Lasting Power; one deals with property and money, and the other deals with personal welfare matters.

The Lasting Power enables you to grant to trusted people, e.g. friends and relatives, power to manage your affairs, and to make decisions about matters such as medical treatment and where you should live. Restrictions and conditions can be built in to ensure that the appointed  attorneys carry out your wishes in the way you would want them to.

Enduring Powers of Attorney

Enduring Powers of Attorney can no longer be made, and were replaced in 2007 by Lasting Powers of Attorney. If you or a family member made an Enduring Power of Attorney, it will still be valid, but you must remember to register it if the person making it becomes mentally incapable.

Court of Protection and Deputyship

Sometimes a person who has not made a Power of Attorney becomes incapable of managing their own affairs. In those cases, a friend or relative will need to look after their affairs but in order to do so, must be granted as order by the Court of Protection. This will usually be a Deputyship Order, and this authorises someone to act in much the same way as they could if they has been made an attorney under a Power of Attorney.
